Motion text
That this House notes the first anniversary of the UK Supreme Court ruling in the case of For Women Scotland Ltd v. The Scottish Ministers, which clarified that for the purposes of the Equality Act 2010, the definition of “woman” is based on biological sex; recognises the significance of this judgment in upholding the integrity of sex-based rights and protections in settings including sport, prisons, healthcare and education; further notes the case of Jennifer Melle, who faced disciplinary action following the use of biologically accurate language in a clinical setting, raising important questions regarding freedom of expression; also notes the case of the Darlington nurses, who raised legitimate concerns regarding the use of female changing facilities by a biological male; welcomes the Government's commitment to lay the Equality and Human Rights Commission's revised Code of Practice before this House after the local elections, and urges prompt action in doing so; and calls on the Government provide clear guidance on single-sex spaces for NHS trusts and workplaces without further delay.
