Motion text

That this House recognises the issue of unadopted roads in new planning developments; highlights that there have been a number of instances within the planning system of developers failing to enter into s38 agreements to ensure money is available to complete roads in their developments; particularly highlights an ongoing issue with unadopted roads and drains in the Wilson Street development in Featherstone, Wakefield, where the developer pulled out of s38 negotiations with the council, left the roads and drainage systems incomplete and are now filing for insolvency, meaning the cost of the road and drain repairs could fall on the residents or the council; and urges the Government to rethink its developer-led approach to s38 agreements and to ensure these agreements are entered into prior to planning permission being granted.
