That this House congratulates the legal representatives of the Kashmir Council for Human Rights in the proceedings before the Supreme Court of India which resulted in Yasin Malik, the Chairman of the Jammu and Kashmir Liberation Front, being released from prison; regrets that legal manoeuvres by the Indian Government prevented the Supreme Court from declaring unlawful the detention orders under which Mr Pir Syed Ali Gilani and Abdul Gani Lowe have been held in custody since October 1993 and who remain in prison with about 700 others Kashmiris including Shakeel Bakshi and Noor Mohammed Kalwal; notes the courage of Shabir Shah, the widely respected Kashmiri leader who has been in jail in India for years on various charges; and who refuses to authorise bail applications being made on his behalf, arguing the Indian authorities should apply the proper judicial processes against him or release him; further notes the KCHR will continue to lend its full assistance in mounting legal challenges in support of Kashmiris detained in Indian jails; and believes Kashmiri political leaders, held in Indian prisons without trial, often denied legal representation, legal advice, proper medical treatment, or even visits from relatives and friends, should be released so they may represent directly the people of Jammu and Kashmir in all the discussions and negotiations necessary to bring self-determination to its people.
